These Terms of Service ("Terms") govern your use of Open Cloud Gate™ (the "Service"), provided by Spark Fire Technologies ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
Open Cloud Gate is a desktop application and account platform that provides an authenticated internet gateway and browser. Features are added over time; we do not guarantee that any specific feature is available at any given moment, and we'll be upfront in our product communications about what's live versus still in development.
New subscriptions include a 5-day free trial. A valid payment card is required to start the trial. Unless you cancel before the trial ends, your card will be charged $40/month (plus any applicable taxes) on a recurring basis until you cancel. You can view your billing status and cancel at any time from your account page's Billing Portal.
You may cancel your subscription at any time through the Billing Portal; cancellation takes effect at the end of the current billing period, and you retain access until then. Except where required by law, payments already made are non-refundable.
You're responsible for keeping your login credentials confidential and for all activity under your account. Accounts are for use by a single individual; we monitor login activity (including approximate, IP-based location) to detect likely credential sharing, and may ask you to verify your identity or take action on accounts showing that pattern.
You agree not to use the Service for any unlawful purpose, to interfere with or disrupt the Service or its infrastructure, or to attempt to circumvent its security or authentication mechanisms.
Open Cloud Gate™, the Open Cloud Gate logo, and the underlying software are the property of Spark Fire Technologies. These Terms don't grant you any rights to our trademarks or branding beyond what's needed to use the Service normally.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free operation.
To the maximum extent permitted by law, Spark Fire Technologies will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, and our total liability for any claim will not exceed the amount you paid us in the 3 months preceding the claim.
We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service and cancel your subscription at any time.
We may update these Terms from time to time. If we make material changes, we'll take reasonable steps to let you know (such as an email to your account address). Continued use of the Service after a change takes effect means you accept the updated Terms.
